Scope
These terms govern the use of MARKETIA and of this website, operated by Cerebr-IA, a Clever company (Colombia). They apply to anyone who accesses the platform or connects an account to it. They reflect the terms published inside MARKETIA (in Spanish). If you contracted the service through a signed agreement, that agreement prevails over these terms.
What the service is
MARKETIA is a professional tool that lets a business manage its own digital presence: handle WhatsApp, Messenger and Instagram messages in a single inbox, moderate comments, publish content, measure and automate its advertising and manage its store orders. It is not a consumer service, nor a tool to access other people's accounts.
Who can use it
- Businesses and agencies, through the people they designate.
- People over 18 with authority to bind the business they represent.
- Only accounts owned by the business, or that it is expressly authorized to manage, may be connected. Connecting a third party's account without permission leads to immediate termination.
Your account
Each person is responsible for their credentials and for what is done from their account. If you suspect unauthorized access, tell us at developer@cerebria.co. The business administrator decides who has access, with which role and to which connected accounts: giving someone access means giving them access to the conversations of that business's customers.
Acceptable use
The platform may not be used to:
- Send unsolicited advertising or automate messages in a massive or deceptive way.
- Harass, impersonate anyone or publish unlawful content.
- Scrape data at scale, resell access or try to bypass technical and security limits.
If we detect such use, we may suspend access without prior notice.
Connected platforms
Users of MARKETIA must also comply with the terms of the platforms they connect, in particular Meta's Platform Terms and Developer Policies, the WhatsApp Business Policy, TikTok's Terms of Service and TikTok for Business terms, and Shopify's terms. Those rules still apply when the work is done from MARKETIA. Each business can disconnect its accounts at any time.
Artificial intelligence
- The platform can draft replies, classify comments and generate analyses with AI models. Results are not infallible.
- Customer-facing features are configurable and reviewable by the business, which remains responsible for what is published or sent on its behalf.
- None of this replaces professional legal, tax or medical advice.
Data and content
The business is the controller of its customers' data; the platform processes it on the business's behalf and following its instructions, as explained in the privacy policy. Content the business uploads (catalog, text, images) remains its own; it grants us only the permission needed to host and display it where it indicates while it uses the service.
Availability
We aim to keep the service continuously available, but it is not provided with a guaranteed uptime commitment unless agreed in writing. There are planned maintenance windows, and the service depends on third parties (Meta, TikTok, payment gateways, hosting) whose outages are beyond our control.
Price and payment
Commercial terms (plan, price, billing period and AI credit consumption) are those in the agreement with each business. Sustained non-payment may suspend the service, after notice.
Term and termination
- The business may stop using the service and disconnect its accounts at any time.
- We may terminate the service for breach of these terms, or with reasonable notice if we stop providing it.
- On termination, the business may request a copy of its data during the following 30 days. After that it is deleted, except what must be kept by law.
Liability
The service is provided as is. To the extent permitted by law, we are not liable for indirect damages or lost profits, and our total liability is limited to what the business paid for the service in the twelve months before the event giving rise to it. Nothing here limits liability that cannot be limited by law, such as fraud or gross negligence.
Governing law
These terms are governed by the laws of Colombia, and any dispute is submitted to its competent courts, without prejudice to any non-waivable rights the business has under its own law.
Changes and contact
